OMAHA, Neb. -- Statements made by accused killer Kyle Bormann will be admissible when he goes to trial in September, a judge ruled on Friday.

Brittany Williams, 21, was shot to death on Jan. 20 as she sat in a drive-through lane in Florence. Bormann, 19, is charged with first-degree murder in her death and is being held without bond.

Bormann made the statements, which Douglas County Attorney Don Kleine has categorized as racist, to police the night Williams was shot.

Bormann's attorneys argued last month that their client's statements should not be allowed, because they were made before he was read his Miranda rights.

According to testimony, Bormamann made statements that he was upset about calls made in a playoff football game, and that "it was because of the blacks."

The judge sided with the state and the statements will be allowed.
