OMAHA, Neb. -- After more than two days of jury selection, testimony is underway in the Roy Ellis Murder trial.Prosecutors said accused killer Ellis talked constantly to fellow prisoners about the Amber Harris case and even cut-out newspaper articles. They said DNA evidence will prove he murdered the little girl and buried her in a shallow grave two and a half years ago.
Late Wednesday afternoon Harris's mother took the stand and in between sobs confirmed jeans, a jacket, jewelry and a bookbag as her daughter’s. This was the first time she had seen those objects.Harris said the last time she saw it was the morning her daughter disappeared. In opening statements, the prosecution Wednesday said while Ellis was in jail for another crime, he asked how long it takes a body to decompose and asked guards how long DNA evidence can remain in tact.Prosecutors said Ellis asked, "If you have a grave, and you don't want it to sink, if you put grass seed in it, would it keep it from sinking?" Harris’s body was found in a shallow grave in Hummel Park in May 2006.Prosecutors said it will be DNA evidence that proves Ellis killed Harris. Its evidence found on the little girl's jeans discovered in a barrel near 21st and Lake, two months after Harris disappeared.Prosecutor Brenda Beadle Wednesday recounted phone calls Ellis made from jail, in which Ellis told a friend who lived near 21st and Lake he needed to get out of jail.Ellis said, “There are things that can really cause a destruction to me, things I need to take care of because it's detrimental to my life"The calls stopped on Valentine's Day, 2006, when Harris's book bag was found in a trash barrel outside the house. The defense argued the prosecution's case is built on the words of jailhouse informants.Defense attorney Patrick Dunn said the DNA sample found on the jeans is not a perfect sample. Then Dunn talked about the DNA evidence in the case, he said it is, “Not a perfect science as it applies to this case because they do not have a perfect evidentiary sample."The prosecution showed school bus security camera video of Harris's last ride home. She got off the bus at 5:41 p.m. and disappeared.Harris's older sister testified Wednesday afternoon about the clothes Harris was wearing on that day.Jalesa Harris said her sister had on her red sweater. It was the sweater investigators found with the body in a shallow grave in Hummel Park. The jury hearing this case consists of eight women and six men, there are two alternates.Jurors also heard from the school bus driver. He said said he saw nothing unusual-- nothing suspcious after Harris got off the bus.The prosecution pointed out how Harris wiped-off her eye make-up before she would get home. Her parents had told Harris she was too young to wear make-up.Stay with KETV.com for further details.
