Kaine Dye Guilty, Jury Says

By unanimous vote, a Pottawattamie County jury said on Friday that Kaine Dye is guilty of first-degree murder.

Closing arguments were held Thursday in a Council Bluffs courtroom.

Dye is accused of killing William Moser, 64, and stuffing his body in a trash can.

He was arrested in January 2007.

Pottawattamie County Attorney Matt Wilber said that even though he feels the decision is correct, he knows the trial hurt both families.

"We've got two families that are hurting right now. You've obviously got Mr. Dye's family, he's going to go away for life, and Bill Moser is gone," Wilber said.

Testmony showed that in January 2007, investigators scoured the scene of the death inside a Council Bluffs apartment. Prosecutors said that is where Dye hit Moser over the head with a baseball bat, beat him and strangled him, then put his body in to a trash can. Prosecutors said a neighbor saw the scene a short time later.

"She says she sees the blood," said prosecutor John Jacobmeier in early trial testimony. "She sees the trash can, and then the defendant tells her, 'I had to kill Bill because Bill was going to call the police.'"

Prosecutors said evidence introduced in their case will include 911 tapes, video of Dye driving around with the trash can in back of a pickup truck and DNA evidence.

Moser's body was found near a pickup truck in Harrison County.

Dye's attorneys said their client was diagnosed as a schizophrenic. They said that during the two months before the slaying, Dye was off of his medication while being held in jail. Three days after his release, Moser was killed.

"His behavior close to the time before and close to the time after will be very important in your making a decision that insanity defense holds water," said defense attorney Jay Mez.

Testimony began on Tuesday afternoon with an expert from the Iowa Medical Examiner's Office, who told the jury how Moser was killed.

Mez said on Friday that he will be filing post-trial motions, appeals and motions for a new trial.

Dye's sentencing is scheduled for May 12.
